Heard a young lawyer at a firm in Detroit say NDAs are basically dead now for talent agreements...

That comment about the FTC's non-compete ban making NDAs harder to enforce got me wondering if the old school 10 year confidentiality clauses I used to sign are even worth the paper they're printed on anymore, has anyone actually tested one in court lately?

Read an article saying Michigan courts are already leaning toward throwing out the really long confidentiality periods.

Gotta disagree with you on this one, Grace. I get why long confidentiality periods look bad on paper, but throwing them out completely feels like a overcorrection. A lot of those longer terms are negotiated by actual people who know what they're signing, not like someone's being tricked into silence forever. Shortening everything to a year or two could really hurt folks who need more time to settle a case or keep private stuff from leaking into the public. I just think courts should focus on the extreme cases rather than scrapping the whole system.
